TTB AND FLORIDA AUTHORITIES CONDUCT JOINT MOONSHINE OPERATIONS

TTB investigators recently joined with special agents from the Florida Division of Alcoholic Beverages and Tobacco for an operation targeting illegal possession of stills and illegal production of distilled spirits. This joint operation resulted in 8 arrests and seizure of 46 stills by Florida authorities.

The possession of unregistered stills and the production of distilled spirits without a federal permit and without payment of tax are federal felony offenses, which may result in the seizure and forfeiture of land and other property associated with the illegal activity.

TTB'S NEW RULING ABOUT FILLING GROWLERS WITH TAXPAID WINE

This week we published TTB Ruling 2014–3, Bottling Taxpaid Wine in Growlers or Similar Containers for Consumption Off of the Premises.  This ruling states that filling wine growlers or similar containers with taxpaid wine for consumption off the premises is considered bottling or packaging under the Internal Revenue Code of 1986 (IRC), as amended.  The ruling holds that any person who engages in this activity must first qualify as a taxpaid wine-bottling house and must comply with all requirements applicable to taxpaid wine bottling houses, including labeling and recordkeeping requirements under the IRC and the regulations in 27 CFR part 24.
