TUTORIALS - COMMON COMPLIANCE AND TAX ISSUES FOUND DURING TTB AUDITS

As part of our Common Compliance Issues series, we've compiled common compliance and tax issues we've encountered over the past few years during brewery, distilled spirits plant, and bonded wine premises audits, so we can assist industry members in understanding and complying with the federal tax, product, and marketing requirements associated with the commodities we regulate.

Within these tutorials, you'll find a list of common audit issues, beginning with the ones we encounter most frequently. You'll also find advice on how to avoid these problems!

WINE STATISTICS

Did you know that TTB publishes data about U.S. wine production, known as the wine statistical release? Data for the wine statistical release comes directly from TTB Form 5120.17, Reports of Wine Premises Operations, that have been filed by wine premises proprietors. We publish a wine statistical release for each month of year.  The releases are published about 45 days after the reports for that month were due. The report covering January 2014 is now available.

A few things to remember about wine statistical releases:

  • Not all wine premises operators file operations reports monthly; some file quarterly or annually.
  • The figures reported may change due to amended reports being filed by proprietors after publication of the release.

Remember, you can also subscribe to receive statistical release publication notifications; doing so means you'll be notified as soon as we have the releases available.

TTB INFORMATION COLLECTION ACTIVITIES IN THE FEDERAL REGISTER

The Department of the Treasury will submit the following information collection requests (i.e., TTB forms) to the Office of Management and Budget (OMB) for review and clearance in accordance with the Paperwork Reduction Act of 1995.

  • TTB F 5000.19, Tax Information Authorization
  • TTB F 5000.21, Referral of Information
  • TTB F 5130.22, 5130.23, 5130.25, and 5130.27, Brewer's Bond, Brewer's Bond Continuation Certificate, Brewer's Collateral Bond, and Brewer's Collateral Bond Continuation Certificate (respectively)

Send your comments on or before April 28, 2014 to be assured of consideration. Obtain copies of the submission(s) by calling 202-622-1295 or emailing PRA@treasury.gov. You can also find the entire information collection request at www.reginfo.gov (TTB OMB  Number: 1513-0001).
