FDA EXTENDS COMMENT PERIOD ON PROPOSED RULES ABOUT NUTRITION AND SUPPLEMENT FACTS LABELS AND ANNOUNCES A PUBLIC MEETINGCertain beers and wines that fall under TTB jurisdiction for production and taxation purposes do not fall within our labeling authority under the Federal Alcohol Administration Act. Examples include beers that do not contain malted barley and hops, as well as wines, including cider, that contain less than 7 percent alcohol by volume. Generally, these products must be labeled in compliance with the TTB Internal Revenue Code requirements found in 27 CFR parts 24, 25, and 27, as well as the U.S. Food and Drug Administration (FDA) labeling requirements found in 21 CFR part 101 - Food Labeling, including 21 CFR 101.9 - Nutrition labeling of food. FDA is proposing to update the Nutrition Facts label to reflect the most recent public health and scientific information, including information about the link between diet and chronic diseases such as obesity and heart disease. FDA stated that the proposed label would also update out-of-date serving size requirements to better align with how much people really eat, and that it will feature a fresh design to highlight key parts of the label such as calories and serving sizes. FDA recently announced that they are extending the comment period by 60 days (to August 1, 2014) for, and will hold a public meeting on the two FDA proposed rules on this matter: The FDA meeting will be held June 26, 2014, 8:30 am - 5:00 pm at the Jefferson Auditorium, U.S. Department of Agriculture, 14th and Independence Avenue, SW, Wing 5 Entrance, Washington, DC. FDA states that the purpose of the meeting is to inform the public of the provisions of the proposed rules and the rulemaking process (including how to submit comments, data, and other information to both dockets), respond to questions about the proposed rules, as well as provide an opportunity for interested persons to make oral presentations.
